Shipping, Returns and Cancellation Policies

Please ensure you read through these terms and conditions carefully before using our website or placing an order. We recommend printing a copy of these terms and conditions for future reference. Please also read our privacy policy regarding your personal information and how we use it.

We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website and will be dated accordingly, it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

When you use certain Ninety2 Automotive services, brochures, websites and publications, please read the additional information provided with regards to such services as this information will provide you with full details on how to use such services.

Definitions

Ninety2 Automotive/the Company/Seller/We/Us/OUR – Ninety2 Automotive T/A TRADING NAME of REGISTERED OFFICE ADDRESS (Registered Office) and the website http://www.ninety2.biz is operated by Us. As user of the website (referred to as “you/your”) you acknowledge that any use of this website, including any transactions you make (“use/using”) is subject to our terms and conditions detailed on this page.

You/Buyer/Purchaser – any person, sole trader, partnership, business, body corporate or other entity detailed in the appropriate section of the sales invoice/order form and shall include all successors, heirs and assigns. Where the Buyer purchases in the course of a trade, profession, vocation or sport (where the buyer is a specialist or enthusiast), it is agreed that such a buyer shall mean a trade buyer. Where a person deals entirely as a consumer, statutory rights shall remain unaffected. Where the term buyer appears within these terms it shall mean both trade and consumer buyer/purchaser unless specified as relating to a trade buyer or consumer buyer individually. If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you place an order.

Goods/Equipment – items detailed in the appropriate section of the sales/order form and it shall be a core term of this agreement that all additional parts, connecting components or ancillary items, not detailed within the sales order form, shall be additional to this agreement.

Price – the consideration due for purchase where a Buyer purchases through or via Ninety2 Automotive brochures or catalogues. Purchasers should note that prices quoted may vary during the currency of brochures (upwards or downwards) and current prices are quoted and only valid at the time of order.

All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions.

Following the entry of the final details of your order, we will send to you an order acknowledgement email detailing the products you have ordered. Please note this email is not an order confirmation or order acceptance from Ninety2 Automotive.

Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it.

Working day – any day excluding Saturdays, Sundays and public or bank holidays.

General

These conditions shall apply to all of the company’s quotations and contracts, orders (including telephone, facsimile transmittal, postal and internet orders) for the sale or supply of goods accepted by the company. For the trade buyer, any other terms or representations, whether implied by statute, made prior to, collateral with or subsequent to the contract or order are hereby excluded and shall not be binding upon the company.

Brochure descriptions, Web Site information and samples on display are indicative only and any specifications, weights, measurements and technical data (whether relating to performance or otherwise) have been prepared by manufacturers and are for guidance only. Additionally, parts or components pictured or described within brochures or websites are for illustration purposes only and may vary in size, specification, colour and fitment dependent up the make and model of your vehicle. Buyers are therefore required to check current specification, colours, weights and measurements with manufacturers or the Company, prior to order. Manufacturers also allow tolerances within the manufacture of their products and also reserve the right to amend specifications, without notice, in order to improve products or where amendment becomes necessary. Manufacturers may also alter specifications to improve products and the Company shall endeavour to inform the Purchaser of any such amendment or change.

The company reserves the right to amend technical or clerical errors in any order without notice. In addition, the buyer shall ensure that all details contained within the order are correct prior to submission to the Company. Subsequent to delivery, the Company shall accept no liability for any error or inaccuracy in order unless notified of such error within seven days of delivery/receipt of any document containing the said error.

Delivery charges and estimated timescales are specified in the shipping options section when you place an order. We make every effort to deliver goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. Ninety2 Automotive shall be under no liability for any delay or failure to deliver the products within estimated timescales.

Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery.

Unless otherwise stated, all shipments will be dispatched within 48 hours and the transit time dictated by the courier chosen, please contact us should you require another shipping method.

We take payment from your card at the time we receive your order, once we have checked your card details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. The option of waiting for stock or receiving a full refund will be given where you have already paid for the goods.

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the relevant UK Data Protection Act.

While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Payment can be made by credit card, debit card or PayPal. Some credit facilities may be available for your purchase, dependent upon your order value and other conditions, available upon request.

All guarantees for products are provided entirely by the manufacturers/UK importers and are subject to terms contained therein. Purchasers are reminded to complete and return all warranty cards/documents upon receipt of goods where appropriate.

Dispatch, Shipping, Tracking, and Exceptions

Dispatch

We endeavour to dispatch all items within 2 working days of order.

Stocked items are usually dispatched on the same day if the order is made before 13:00hrs.

We will not be held liable for any shipping costs, labour charges or consequential losses incurred due to delayed items. If an item is urgent, please contact us before placing the order to check stock and dispatch time.

Shipping

There are restrictions on some products to specific locations, and some products cannot be shipped to international destinations at all. It is the buyer’s responsibility to ensure that any item purchased can be legally imported into that country.

When you place an order, our shopping cart system will estimate shipping costs based on the weight (or volumetric weight for overseas shipping) of the item and your location. As this is not a comprehensive system, we reserve the right to request further payment if the quoted postage costs do not meet the actual costs. In addition, if you find that a quoted shipping cost is excessive, please contact us before completing your purchase for an accurate quote.

The Shipping and Taxes estimate does not include any Import Tax, VAT or Duties you may be liable to pay upon import into your country. It is the buyers responsibility to pay these charges upon import and to adequately research such charges before purchasing any items. If import duties are not paid, the item may be returned back to us. The initial shipping costs and any extra charges we incur as a result of this will be deducted from any refund made to you.

Before emailing for a shipping quotation, please add the item to your cart, click ‘Estimate Shipping & Tax’ under the Subtotal, input your address details and click ‘Estimate Shipping & Tax’. This will give you your shipping options.

As stated above, for urgent orders please contact us to ensure we have stock and can dispatch. The cut off time for same day dispatch is 1300hrs Monday – Friday. We do not dispatch any orders on Saturday or Sunday.

Tracking

If you have paid for a tracked service, or a tracking number is provided by our courier or postal service, this will be provided to you within 24 hours of posting.

Exceptions

There are currently no exceptions.

Payment Terms, Returns, Faulty

Payment

All customers must pay for their parts / invoices in full prior to shipping your order.

We do not offer credit terms under any circumstances.

All goods remain the property of Ninety2 Automotive until paid for in full.

Returns

We hope you will be delighted with your product purchased online from http://www.ninety2.biz, however we understand that sometimes you may wish to return your product. Please find below details of our returns policy:

You may return your product within 14 days by simply logging into your account, view the order using the “Complete Orders” link under the My Account menu and click the Return Item(s) button. After 14 days we reserve the right to charge up to a 10% restocking fee to cover card fees, time and packing costs.

Custom made or special order items can only be returned for a full refund if faulty / mis-described. If they are returned for any other reason, we reserve the right to decline the return or if accepted, they may be subject to a 25% restocking fee.

Most Ninety2 Automotive branded products are considered ‘custom made’ and therefore cannot be returned under the distance selling regulations.

Regardless of the return reason, the buyer is responsible for return postage. On unwanted items, the buyer is also responsible for the initial postage cost. If postage costs are agreed to be covered by Ninety2 Automotive the maximum value paid will be equal to the initial shipping cost on the order.

We will notify you via email of your refund once we’ve received and processed the returned item. Unwanted items must be unused and in the condition they were sent. We may also charge a restocking fee. This is to prevent customers from ordering parts ‘just in case’ they need them. If products are not unused or in good condition, we reserve the right to withhold all or part of the refund payment. This does not affect your statutory rights.

Upon receipt of the product we will check the content to ensure all parts have been returned and if so, we will authorise a credit to the account used to make the purchase. We aim to credit your account within 10 days of the product return.

Where a part is missing we will contact you and advise of the charge for any missing element. We will then credit your account minus the charge. You may return the missing part however the cost of postage will be at your expense.

If the product has been misused or not assembled in the proper manner, we reserve the right to withhold all or part of the refund payment. This does not affect your statutory rights.

Your rights under the Distance Selling Regulations are not affected by this returns policy.

Alternatively, the incorrect, faulty or not fit for purpose part can be collected by our courier. Failed collections will be charged at £12. Ninety2 Automotive will not be liable for any consequential losses due to any faulty or incorrect parts received.

The following Goods may not be returned to us for credit:
(a) Goods which have been specially ordered at your request;
(b) Electrical parts;
(c) Glass parts;
(d) Hazardous parts where the seals are not intact;
(e) Hazardous/explosive parts (and any parts included in the Dangerous Goods Act) that are not in their original packaging;
(f) Goods that have already been used or fitted;
(g) Goods with damaged original packaging and/or which are not in a resalable condition;
(h) Goods which were purchased as part of a promotion or marketing campaign;
(h) any other Goods identified to you by us or our Agent.

Faulty/Damaged Items, or Wrong Item Received

If you receive a part that is incorrect, faulty or not fit for purpose, we reserve the right to take a deposit payment (up to the full value of the item) prior to sending out any replacement parts. The deposit will be refunded in full upon return of the incorrect, faulty, or not fit for purpose part, unless the item needs to be returned to the manufacturer for a warranty inspection / report.

Discount Codes & Vouchers/Gift Cards

Vouchers are non-transferrable.

Not to be used in conjunction with any other offer.

Vouchers cannot be used in conjunction with any orders placed using a finance payment.

Vouchers have to be spent in full within a single transaction by the date specified.

Cash refunds are not applicable, if there is need for a refund/warranty claim the monetary value of the individual item will be credited to your account as a store credit only where a like for like replacement is not available.

Vouchers can only be used as payment method over the telephone or in store only, there will be no facility to use this as a payment type in the checkout on the website.

Minimum spend required (Excluding shipping costs).

Ninety2 Automotive reserves the right to end promotions at any time.

Discount vouchers cannot be used to purchase gift vouchers.

Discount vouchers cannot be used in association with other voucher offers.

Voucher Codes are single use per account.

Discount vouchers cannot be applied retrospectively.

Certain brand exclusions may apply.

Surcharge Item Returns

On some products, we may retain a ‘Surcharge’, which will be refunded on the return of your old item. In all cases, the part must be in a serviceable condition with only minor parts requiring changing. We will test all parts returned prior to issuing a refund. If the part fail the tests, the ‘Surcharge’ will not be refunded, and the test fee and Shipping would need to be paid if the worn parts are to be returned to you.

Warranty and Claims

All Genuine and OEM Parts carry a minimum of 1 Year Warranty (2 Years in some cases) when fitted in a standard car. With most manufacturers, any performance enhancing modifications will void the warranty on those parts.

For any aftermarket / upgrade parts the warranty lies with the manufacturer and in most cases, there is no warranty other than for manufacturing defects.

In all warranty cases, the manufacturer andNinety2 Automotive are not liable for any labour cost claims.

In the event of a warranty claim, we will require the item to inspect or to send to the manufacturer to follow their claims procedure. If you require a replacement item to ensure your vehicle is not off the road for a prolonged period, we reserve the right to charge for the replacement item. Upon a successful claim, this charge would be refunded. If the claim is not upheld, we will return your items to you in the condition they were sent and no refund will be made.

If it is possible to claim Labour costs from the manufacturer the maximum per hour at book time (Auto – Data). We will require your vehicle details to verify book time.

Please Note – All Dual Mass Flywheels have no warranty when fitted to modified vehicles. This includes kits fitted with the Sachs Race Clutch Kits.

Warranty Exclusions

Damage caused by your failure to take all reasonable steps to prevent mechanical damage from occurring, for example, taking appropriate action in the event of warning lights appearing.

Damage or defects caused by not having the vehicle serviced in accordance with the manufacturer’s /Ninety2 Automotive recommendations.

Damage or defects caused by improper use of the vehicle, Accident damage, neglect, or use of the vehicle for motorsport activities.

Responsibility to Comply with Home Country Laws

It is the customers responsibility to ensure they comply with rules and laws relating to their home country. We accept no responsibility for the use of any of our products on the public highway. When purchasing parts it is the customer’s responsibility to ensure they comply with rules and laws relating to their home country. Ninety2 Automotive will not be held responsible for any future actions or issues relating to any of our products or services.

Environmental Policy

We take our impact on the Environment very seriously and we aim to reduce our impact on the planet, as much as possible, and have created a simple Environmental Policy. We:

Recycle

We aim to recycle as much as possible, and ensure waste plastics, paper, card etc. are collected and recycled regularly.

Reuse

Where possible we reuse packaging and boxes. We source used packaging locally to meet most of our packaging needs.

Cutting Use

To save printing invoices, (saving both toner and paper use). We email all our Customer Invoices.

Privacy Policy

Where possible we will try and direct all customers to our website when placing an order. In the event of taking an order over the phone we will need to know your name, email address, billing and delivery address, contact telephone number. This allows us to email you an invoice with payment details for payment. Once paid, we will then process and fulfil your order and notify you of the status of your request.

Ninety2 Automotive do not store any financial details. This is handled by our payments provider.

We may sometimes use cookies on this website to record aggregate statistical information about visitors to our site and the use our visitors make of the website. When collected, this information is used by us to make improvements to our website and enhance the visitor experience.

Where we have given you (or where you have chosen) a password so that you can access certain parts of our site, you are responsible for keeping this password confidential.
